1. Introduction

Welcome to SA ID Checker. These Terms of Service ("Terms") govern your use of our website located at www.saidchecker.co.za and our ID validation services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.

2. Service Description

SA ID Checker provides South African ID number validation services, including:

  • ID number format validation
  • Checksum verification using the Luhn algorithm
  • Extraction of demographic information (date of birth, gender, citizenship status)
  • Bulk validation capabilities
  • API access for integration

Important: Our service validates the mathematical structure of ID numbers. It does not verify whether an ID number has been officially issued by the Department of Home Affairs or whether it belongs to a specific individual.

3. Account Registration

To access certain features of the Service, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. Acceptable Use

You agree to use the Service only for lawful purposes. You shall not:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Use the Service to validate ID numbers without proper authorization from the ID holder
  • Resell, redistribute, or sublicense the Service without our written consent
  • Use automated systems or bots to access the Service in excess of your plan limits
  • Interfere with or disrupt the Service or servers
  • Attempt to reverse engineer or extract source code from the Service
  • Use the Service to discriminate against individuals based on the information extracted

5. Subscription and Payment

5.1 Free Tier

We offer a free tier with limited monthly validations. The free tier is subject to fair use policies and may be modified or discontinued at our discretion.

5.2 Paid Subscriptions

Paid subscriptions are billed monthly in South African Rand (ZAR). By subscribing to a paid plan, you agree to:

  • Pay the subscription fees at the start of each billing period
  • Automatic renewal unless cancelled before the renewal date
  • Provide valid payment information

5.3 Cancellation

You may cancel your subscription at any time. Upon cancellation:

  • You will retain access until the end of your current billing period
  • No refunds will be provided for partial billing periods
  • Your account will revert to the free tier

5.4 Price Changes

We reserve the right to modify our prices. We will provide at least 30 days notice of any price changes. Continued use of the Service after price changes constitutes acceptance of the new prices.

6. API Usage

If you use our API, you additionally agree to:

  • Keep your API keys confidential
  • Not share API keys with third parties
  • Respect rate limits and usage quotas
  • Implement reasonable error handling
  • Not use the API in a way that could damage or impair the Service

7. Intellectual Property

The Service and its original content, features, and functionality are owned by SA ID Checker and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code, unless laws prohibit these restrictions or you have our written permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • The Service will meet your specific requirements

9. Limitation of Liability

To the maximum extent permitted by applicable law, SA ID Checker shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or business opportunities
  • Business interruption
  • Decisions made based on validation results
  • Any unauthorized access to or alteration of your data

Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless SA ID Checker and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

11. POPIA Compliance

Our Service is designed to be compliant with the Protection of Personal Information Act (POPIA). However, you are responsible for:

  • Ensuring you have proper authorization to validate ID numbers
  • Complying with POPIA and other applicable data protection laws
  • Obtaining necessary consents from data subjects
  • Implementing appropriate security measures for any data you process

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

  • Breach of these Terms
  • Fraudulent, abusive, or illegal activity
  • Non-payment of fees
  • Extended periods of inactivity

Upon termination, your right to use the Service will cease immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of South Africa.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
